Shuhaily Pleads Not Guilty to Two Assault Charges
SEPANG: Malaysian Border Control and Protection Agency (AKPS) Director-General Datuk Seri Mohd Shuhaily Mohd Zain pleaded not guilty to two charges of voluntarily causing hurt to two police officers last month.
Mohd Shuhaily, 54, entered his plea after both charges were read out before Magistrate Khairatul Animah Jelani here today.
The charges were brought under Section 323 of the Penal Code, which carries a maximum sentence of one year’s imprisonment, a fine of up to RM2,000, or both upon conviction.
Mohd Shuhaily was accused of voluntarily causing hurt to Mohamad Faiz Saman between 1.27 pm and 1.35 pm near Counter J, Level 5, Terminal 1 of Kuala Lumpur International Airport (KLIA), on September 28.
He was also charged with voluntarily causing hurt to Muhammad Ekmal Sofwan Dirman at the same location and time.
The prosecution was conducted by Deputy Public Prosecutors Shahrizat Ismail, Datuk Ahmad Sazali Omar, Nor Azizah Aling and Nur Aqiilah Ahmad Rofaie.
Mohd Shuhaily was represented by lawyers Datuk Rosal Azimin Ahmad, Datuk Yaacob Md Sam, Datuk Dr Baljit Singh Sidhu, Datuk Akberdin Abdul Kader, Datuk Ahmad Zaidi Zainal, Md Yunos Shariff, Muhammad Rafique Rashid Ali and Kitson Foong.
Appreciates Public Support
Earlier, when approached by reporters, Mohd Shuhaily expressed his gratitude to members of the public who had offered their support through prayers and messages.
He said the encouragement from people across all walks of life meant a great deal to him as he faced the legal proceedings.
“That is what gives me the strength and confidence to continue going through this legal process,” he said during a brief press conference at the lobby of the Sepang Sessions and Magistrates’ Court Complex this morning.
Mohd Shuhaily said he would leave it to the court to conduct the legal proceedings in accordance with the proper procedures.
He also announced that the press conference would be his last concerning the ongoing legal proceedings.
“This is my final press conference regarding this legal process. Once the court proceedings are concluded, my lawyers will speak on my behalf,” he said.
Mohd Shuhaily arrived at the court complex at 7.30 am and was later seen having breakfast at the cafeteria.
Also present to show support was Port Klang AKPS Commander Datuk Nik Ezanee Mohd Faisal.
Security presence involving police personnel and members of the Malaysian Volunteer Corps Department (RELA) was also increased at the court complex, with only court staff and police officers permitted to park their vehicles within the premises.
On October 17, Home Minister Datuk Seri Saifuddin Nasution Ismail said the Attorney General’s Chambers had requested several improvements to the investigation papers, including additional clarification and further investigative action.
The investigation papers had previously been submitted to the Attorney General’s Chambers after police recorded statements from 25 witnesses.
