Solar Hybrid Project Corruption Case: Rosmah Allowed to Submit Additional Evidence in Appeal

PUTRAJAYA: The Court of Appeal here today allowed Datin Seri Rosmah Mansor’s application to submit additional evidence in her appeal against her conviction in the RM1.25 billion Sarawak solar hybrid project corruption case.

Court of Appeal Judge Datuk Dr Choo Kah Sing, when delivering the decision, said the additional evidence pertaining to the 16th prosecution witness, Rayyan Radzwill Abdullah, may have a material impact on the findings made by the High Court.

The new evidence includes a statutory declaration sworn by Rayyan, who was also the prosecution’s key witness during Rosmah’s trial, in addition to his oral testimony which will be given again.

The court also ordered that the additional evidence be recorded before a different Kuala Lumpur High Court judge.

Rayyan will also be recalled for cross-examination and re-examination, with the proceedings to be conducted within two weeks after the next case management.

Previously, Rosmah had filed an application at the Court of Appeal to submit new evidence in her appeal.

In a notice of motion dated 21 July, Rosmah sought permission under Section 61 of the Courts of Judicature Act 1964, as well as Rules 68 and 69 of the Rules of the Court of Appeal 1994, to submit three additional documents as evidence during the hearing of her appeal.

In the supporting affidavit for the application, the wife of former Prime Minister Datuk Seri Najib Razak claimed that Rayyan was pressured into giving testimony to show that she was guilty during the trial.

Rosmah also sought permission to recall Rayyan to give further evidence, either before the Court of Appeal or the High Court.

If allowed, she wants the witness’s additional oral testimony to be recorded and accepted as new evidence in the appeal.
