Soldier Charged With Kicking Five-Year-Old Daughter

KOTA BHARU: A soldier was charged in the Sessions Court here today with abusing his five-year-old biological daughter by allegedly kicking her at a restaurant last week.

The accused, Mohamed Nisa Mohamed Nasir, 40, pleaded not guilty after the charge was read before Judge Zulkifli Abdullah.

According to the charge, he allegedly committed the offence against his daughter at a restaurant at Lot 143, Batu 2, Jalan Kuala Krai here at 10.55 pm on Sept 11.

As the victim’s biological father, the accused was charged under Section 31(1)(a) of the Child Act 2001, which carries a maximum fine of RM50,000 or imprisonment of up to 20 years, or both, upon conviction.

Earlier, Deputy Public Prosecutor Syazalia Che Suhaimin requested that bail not be granted as the case involved a child, expressing concern that the accused could interfere with the victim, who is also his biological daughter.

However, defence lawyer Zuhaidie Akmal Hasan Basri appealed for bail, saying his client had served in the military for 19 years and has three children.

He also told the court that the accused’s wife is unemployed and undergoing haemodialysis treatment, and requires her husband’s assistance for regular hospital visits.

According to the lawyer, the accused has no previous record involving domestic violence or similar offences and is not considered a flight risk as he remains subject to monitoring by the military unit in which he serves.

The court subsequently granted the accused bail of RM10,000 with one local surety and imposed several additional conditions.

Among the conditions, the accused is prohibited from interfering with any prosecution witnesses, particularly the victim, must surrender his passport to the court if he has one, and must report to Pengkalan Chepa Police Station or the nearest police station every two weeks until the case is concluded.

The court fixed Oct 22 for case mention and submission of documents.

Earlier, a video showing a man allegedly kicking a child at a restaurant here went viral on social media, drawing widespread public criticism.
