Strict Action Against Bangladeshi National for Document Forgery: RM50,000 Fine or 12 Months Jail in Kuala Lumpur Sessions Court
KUALA LUMPUR, Jan 14: A Bangladeshi national and director of foreign company Nisa Resources Sdn Bhd, Mohammed Jasim, has been fined RM50,000 (approximately 1.55 million Bangladeshi taka) by the Kuala Lumpur Sessions Court after pleading guilty to two charges of document forgery. If the fine is not paid, he will face 12 months of imprisonment.
Court investigations revealed that on 27 September 2023, Jasim allegedly used a forged Letter of Award to secure approval under the Workforce Recalibration Program (RTK) 2.0 for 14 foreign workers. The forged document was related to an “Additional and Alteration Project” for a condominium in the capital.
The prosecution was handled by Nidzuwan Abd Latip, Deputy Public Prosecutor from the Malaysian Anti-Corruption Commission (MACC). Jasim was represented by lawyer Farith Emier Farhan Morni, who requested a minimal fine during mitigation, citing that Jasim supports a housewife spouse and five children, and also highlighting his health condition.
Judge Suzana Hussin imposed the RM50,000 fine and stated that failure to pay would result in a 12-month jail sentence.
The case was filed under Sections 468 and 465 of the Malaysian Penal Code, which deal with forgery and fraudulent use of documents.
Investigative Perspective: This case represents a serious instance of document forgery where false documentation was used to obtain government approval for foreign workers.
According to MACC, such offenses are not limited to financial fraud but also undermine lawful labor recruitment processes and the regulation of the local economy.
The case demonstrates that the authorities are actively detecting and cracking down on fraudulent practices, even when companies attempt to secure approvals through forged documents.
Analysts believe that this ruling sends a strong warning to companies and agents involved in foreign worker recruitment, discouraging similar fraudulent activities in the future.
