Labourer Jailed Four Years For Kidnapping Man To Thailand

PASIR MAS: A labourer was sentenced to four years in prison and fined RM6,000 by the Sessions Court here today on two charges of kidnapping a man and stealing a car in Tendong here last month.

The accused, Syamsul Azroy Che Anuar, 32, pleaded guilty after the charges against him were read before Judge Zulkpli Abdullah.

For the first charge, the accused was charged together with three others who are still at large for kidnapping Mohd. Shahrul Nizam Mohd. Asri, 35, with the intention of secretly and wrongfully confining the victim in an incident at a house in Tendong at 3.30 p.m. on 6 June.

The accused was charged under Section 365 of the Penal Code and read together with Section 34 of the Penal Code, which provides for imprisonment of up to seven years and a fine.

For the second charge, the accused together with three individuals who are still at large stole a Volkswagen Jetta car belonging to Mohd. Taufik Mohd. Asri, 25, at the same date and location. The accused was charged under Section 379(1) of the Penal Code and read together with Section 34 of the Penal Code, which provides for imprisonment of up to seven years and also a fine.

According to the facts of the case, during the incident, the victim, Mohd. Shahrul Nizam Mohd. Asri, was at home before being approached by a group of four men including the accused who arrived in a Myvi car and asked where Mohd. Taufik was because he had not paid a debt.

The victim then informed them that Mohd. Taufik, who is his younger brother, was not at home before the accused detained the victim. At the same time, the accused and the other three also took away a Volkswagen Jetta vehicle belonging to Mohd. Taufik.

The victim was then confined in a house in Thailand before being released the following day and rescued by Thai police. In this case, the accused also used a weapon during the kidnapping and the action was reckless without considering the consequences, besides the kidnapping victim being taken to Thailand.

The prosecution was conducted by Deputy Public Prosecutor, Siti Aiysha Na’ilah Harizan, while the accused was unrepresented by counsel. Earlier, Siti Aiysha Na’ilah applied for a commensurate sentence to be imposed to serve as a lesson to the accused.

She said that in this case, the accused also used a weapon during the kidnapping and the action was reckless without considering the consequences, besides the kidnapping victim being taken to Thailand.

Syamsul Azroy, however, applied for a lenient sentence to be imposed and for the sentence to run from the date of arrest. The court then sentenced him to four years in prison from the date of arrest on 16 June and a fine of RM3,000 for the kidnapping charge, with three months in prison if he failed to pay the fine.

For the second charge, the accused was sentenced to three years in prison and a fine of RM3,000, with three months in prison if he failed to pay the fine. The court ordered both sentences to run concurrently.
