3R problems probed without fear or favor, Home Minister says Muhyiddin’s statements probe ongoing

Saifuddin was answering a question posed of him by Tan Sri Abdul Hadi Awang (PN-Marang), asking him to list the definitions of situations fit for classification as 3R.

Abdul Hadi had also questioned what guarantees are in place to ensuring that the law is applied in a fair manner and not to limit the Opposition’s involvement in the parliamentary process.

Said Saifuddin, the laws controlling the 3R concerns include the Sedition Act, Penal Code, and Communications and Multimedia Act (CMA).Datuk Seri Saifuddin Nasution Ismail guarantees the Dewan Rakyat that all 3R (race, religion and royalty) issues are examined by the police without regard to preference or fear.

“The Home Ministry would want to provide the assurance that, regardless of political inclination, all 3R cases are investigated by the police without fear and favour,” he stated in a parliamentary written reply dated Dec 11.

“I have let the police complete their inquiries free from disturbance and open access.

“Therefore, I would want to remind all parties to refrain from making any comments touching on 3R elements,” he said.

The Sedition Act’s Section 4 and Section 3(1) clearly outline activities judged seditious.

Regarding the Penal Code, Section 298 and Section 298A are looked at for offences that can disturb religious peace.

Section 505, meantime, is applied to offences involving encouragement of communal conflict.

Regarding the CMA, Section 233 addresses the use of network and services to dissemin obscene, indecent, false, menacing, or offensive content; Section 211 addresses crimes connected to offensive content.

“This means any act, remark, post, speech, publication that touches on 3R and goes against the above regulations is forbidden and investigations can be carried out pursuant to stipulations in the stated laws,’ he said.

Saifuddin responded to another query posed by Datuk Rosol Wahid (PN-Hulu Terengganu) on the latest on the matter involving the statutory declaration of Tan Sri Muhyiddin Yassin, stating that the inquiry is still under progress.

“The investigation papers were sent to the Attorney General’s Chambers on Sept 11, and it has since been returned for additional inquiry,” Saifuddin Nasution said.

Muhyiddin turned over records to the police in relation to inquiries into the 3R matter on Aug 20.
