SHAH ALAM: Datuk Seri Mohd Shuhaily Mohd Zain continues to serve as Director-General of the Malaysian Border Control and Protection Agency (AKPS) as he has yet to receive any official instructions regarding the decision to return him to the Royal Malaysia Police (PDRM).

His lawyer, Muhammad Rafique Rashid Ali, said his client still holds the authority of director-general as long as the transfer process has not been finalised, Sinar Harian reported.

“He has yet to receive any instructions or official letter. Therefore, he continues to carry out his duties as he still holds the authority of director-general.

“So far, my client has not been found guilty of any offence and can continue performing his duties and responsibilities as usual,” he told reporters at the court complex here today.

According to Rafique, Mohd Shuhaily continues to perform his duties as usual, including chairing meetings of the agency.

Following this, he called on Home Minister Datuk Seri Saifuddin Nasution Ismail to clarify Mohd Shuhaily’s status to avoid confusion and speculation.

“The public is now questioning the situation because the minister has said one thing, but what is happening suggests otherwise.

“Therefore, the minister needs to clarify this matter as it has given rise to various speculations,” he said.

On October 29, Saifuddin announced that Mohd Shuhaily had been returned to the PDRM.

Mohd Shuhaily, who was appointed AKPS Director-General for the period from July 1, 2025, to June 30, 2027, reportedly resumed his duties on November 2 after taking a week of leave.

Earlier, on October 21, he pleaded not guilty at the Sepang Magistrates’ Court to two charges of intentionally causing injury to two police personnel near Counter J, Level 5, Terminal 1 of Kuala Lumpur International Airport (KLIA) on September 28.
